In response, Pearl Eliadis said that anti-bullying policies cannot rely solely on whether someone is offended by another person’s words. She explained that if disciplinary measures are imposed without clear, objective criteria, such restrictions on speech could face legal challenge. Eliadis added that recent court decisions have underscored the importance of protecting freedom of expression in educational settings, particularly when it comes to political speech, which remains one of the most strongly protected forms of expression in Canadian law.
